This Privacy Policy (“Policy”) describes how Livily LLC (“Livily,” “we,” “us,” or “our”) and its subsidiaries, parent, and affiliated companies (collectively, the “Livily Group”) collect, use, share, and protect your information when you use our website www.livily.com, mobile application, and related services (collectively, the “Livily Platform”).

By visiting or using the Livily Platform, registering as a Guest or Property Supplier, or entering into any transaction through or within the Livily Platform, you agree to the data practices described herein and to Livily’s General Terms and Conditions.


1. Definitions

For consistency with our General Terms and Conditions, the following definitions apply to this Privacy Policy:

  • “Guest” means any registered user who books or uses accommodation services or related products through the Livily Platform or Partner Network.

  • “Property Supplier” (also referred to as “Host,” “Owner,” or “Property Manager”) means any individual or entity listing or offering a property or related service for booking through the Livily Platform.

  • “Partner Network” means any affiliated travel website, corporate travel platform, or distribution system that displays Livily Listings.

  • “Personal Information” means any information that identifies, relates to, describes, or can reasonably be associated with an individual.

  • “Listing” means a property or accommodation available for booking as described in Livily’s General Terms and Conditions.


2. What Information We Collect

In General

We collect information that you voluntarily provide when using the Livily Platform or when corresponding with us directly. This includes:

  • Contact and Identification Information: First and last name, email address, telephone number, postal address, and government-issued identification (if required for verification).

  • Billing Information: Credit or debit card details, bank account information (if receiving Host payouts), and related billing data.

  • Device and Technical Data: Internet Protocol (IP) address, browser type, operating system, device identifiers (including MAC address), and access times.

  • Usage Information: Searches, bookings, preferences, and communications made through the Livily Platform or Partner Network.

  • Optional Profile Information: Property preferences, amenities, travel habits, or loyalty program identifiers when voluntarily provided.

Guests

When you book a property, we collect information necessary to process and confirm your reservation, including guest names, stay dates, contact details, and payment information.

Property Suppliers

When you register as a Property Supplier, we collect business and payment details needed to manage your listings, verify your identity, and process payouts.

Tenant or Occupant Information

If you make a booking on behalf of another person, you represent that you have obtained their consent to share their information with Livily for reservation and verification purposes.


3. Communication Preferences

SMS Communications

By registering on the Livily Platform, you consent to receive transactional and limited automated marketing messages from Livily LLC. Message and data rates may apply. To stop receiving text messages, reply STOP; for assistance, reply HELP. Your phone number is used solely for operational and consented marketing purposes and will not be sold or shared without authorization.

Email Communications

We may send you service updates, booking confirmations, and promotional offers related to your use of the Livily Platform. You can unsubscribe from marketing emails by using the link provided in each email. Transactional or administrative notices (e.g., booking updates, account notifications) cannot be opted out of.


4. Information from Other Sources

We may receive information from:

  • Affiliates and Partner Networks, such as Travel Management Systems (TMS) and distribution partners (e.g., Amex GBT, Egencia, CWT).

  • Payment Processors, including Stripe, Inc., used for payment collection and Host payouts under its Privacy Policy at https://stripe.com/legal/end-users.

  • Social Media Accounts, when you link your Livily account to a social media profile or use third-party login features.


5. Automatic Data Collection

When you use the Livily Platform, we automatically collect certain data to improve functionality and prevent fraud, including IP address, browser type, referring URLs, device identifiers, and browsing actions on the Livily Platform and Partner Networks.


6. How We Use Information

We use collected data to:

  • Process reservations, payments, and Host payouts.

  • Verify identities, prevent fraud, and ensure platform security.

  • Communicate with Guests and Property Suppliers regarding bookings, promotions, and account updates.

  • Manage accounts and deliver support.

  • Improve Livily’s Platform, Partner Network integrations, and user experience.

  • Enforce our General Terms and Conditions and comply with legal obligations.


7. With Whom We Share Information

Livily may share information with:

  1. Property Suppliers – to fulfill confirmed bookings.

  2. Guests – to facilitate booking communication and verification.

  3. Third-Party Service Providers – including payment processors, identity verification providers, customer support, analytics, and marketing partners.

  4. Partner Networks – to distribute Listings and bookings across integrated systems.

  5. Corporate Affiliates – within the Livily Group for operations, analytics, and compliance.

  6. Legal or Regulatory Entities – when required by law, subpoena, or court order.

  7. Business Transactions – such as mergers, acquisitions, or corporate reorganizations.

Livily does not sell Personal Information or share it for cross-context behavioral advertising without user consent.


8. Cookies and Tracking Technologies

We use cookies, web beacons, and similar technologies to:

  • Maintain secure sessions and remember user preferences.

  • Analyze website traffic and usage patterns.

  • Deliver personalized content and ads through authorized channels.

You may adjust cookie preferences through your browser settings; however, disabling cookies may limit platform functionality.


9. Data Security

Livily implements administrative, technical, and physical safeguards to protect your data from unauthorized access, disclosure, or misuse. While no system is completely secure, we continuously evaluate and update our security controls.


10. Data Retention

We retain Personal Information for as long as necessary to fulfill bookings, comply with legal obligations, resolve disputes, and enforce agreements.


11. International Data Transfers

By using the Livily Platform, you consent to the transfer and processing of your data in the United States. Livily adheres to the principles of the U.S.–EU and U.S.–Swiss Data Privacy Frameworks as applicable.


12. Children’s Privacy

The Livily Platform is intended for users aged 18 and older. We do not knowingly collect data from children under 13. If we learn that a minor’s data has been collected, we will delete it promptly.


13. Changes to This Policy

Livily may amend this Privacy Policy periodically. Updates will be posted on this page with a revised “Last Updated” date. Material changes may also be communicated by email to registered users.

California Consumer Privacy Addendum (CCPA/CPRA Notice)

Effective Date: October 24, 2025

This Addendum supplements the Livily LLC Privacy Policy and applies solely to California residents, as required under the California Consumer Privacy Act of 2018 (CCPA) and the California Privacy Rights Act of 2020 (CPRA).

Livily LLC (“Livily,” “we,” “us,” or “our”) is a Delaware limited liability company operating an online marketplace and technology platform that connects Guests and Property Suppliers for booking furnished properties and related services. Livily acts as a service provider and limited payment collection agent for Property Suppliers.


1. Categories of Personal Information Collected

In the preceding twelve (12) months, Livily has collected the following categories of information from Guests, Property Suppliers, and visitors to our Platform:

2. Sources of Collection

  • You, when you register, book, or list a property.

  • Third-party Partner Networks (e.g., GDS/TMS systems) that distribute Livily Listings.

  • Third-party service providers (e.g., payment processors, identity verification partners).


3. Use of Personal Information

We use Personal Information for the following business purposes:

  • To provide, support, and improve our Platform and services.

  • To facilitate Guest reservations and Property Supplier payouts.

  • To detect, prevent, and investigate fraud or illegal activities.

  • To provide customer service and respond to inquiries.

  • To comply with legal and regulatory requirements.

We do not use or disclose Sensitive Personal Information for purposes beyond those permitted by CCPA/CPRA Section 7027(m).


4. Disclosure of Personal Information

Livily has disclosed the categories of information listed above to service providers and contractors for legitimate business purposes, including:

  • Payment processing (Stripe, Inc.)

  • Fraud and identity verification vendors

  • Data hosting and analytics providers

  • Affiliate corporate entities within the Livily Group

We have not sold Personal Information or shared it for cross-context behavioral advertising in the preceding twelve (12) months. Livily does not knowingly sell data of individuals under the age of 16.


5. Your Privacy Rights (California Residents)

You have the following rights under CCPA/CPRA:

  1. Right to Know – You may request disclosure of the categories and specific pieces of Personal Information we have collected about you.

  2. Right to Delete – You may request deletion of your Personal Information, subject to certain exceptions (e.g., legal retention, fraud prevention).

  3. Right to Correct – You may request correction of inaccurate Personal Information.

  4. Right to Opt-Out of Sale/Sharing – Livily does not sell or share Personal Information for behavioral advertising; no opt-out is required.

  5. Right to Limit Use of Sensitive Information – Livily does not use Sensitive Personal Information beyond core business purposes.

  6. Right to Non-Discrimination – Exercising your privacy rights will not result in any discriminatory treatment.

Livily retains Personal Information only for as long as reasonably necessary to fulfill the purposes described in our Privacy Policy, comply with our contractual obligations, and satisfy applicable legal or audit requirements.

EU / UK General Data Protection Regulation (GDPR) Addendum

Effective Date: October 24, 2025

This Appendix supplements the Livily Privacy Policy and applies to residents of the European Economic Area (EEA), Switzerland, and the United Kingdom (“European Users”).

Livily LLC (“Livily,” “we,” “us,” “our”), a Delaware limited liability company, provides and operates the Livily Platform as described in the Privacy Policy. When offering accommodations or related services to individuals in the EEA or UK, Livily acts as a data controller for Guests’ information and as a data processor for information processed on behalf of Property Suppliers.


1. Legal Basis for Processing

Livily processes Personal Data only when a lawful basis exists under Article 6 GDPR or UK GDPR. These include:

  • Contract Performance (Art. 6(1)(b)) – to create accounts, process bookings, and remit Host payouts;

  • Legal Obligation (Art. 6(1)(c)) – to comply with tax, accounting, and anti-fraud requirements;

  • Legitimate Interests (Art. 6(1)(f)) – to maintain platform security, prevent misuse, and improve services;

  • Consent (Art. 6(1)(a)) – for optional marketing, cookies, and communications where required by law.

When we rely on consent, you may withdraw it at any time without affecting prior lawful processing.


2. Your Rights under GDPR / UK GDPR

European Users have the following rights:

  1. Access – Request a copy of your Personal Data.

  2. Rectification – Correct inaccurate or incomplete information.

  3. Erasure (“Right to be Forgotten”) – Request deletion where no longer necessary.

  4. Restriction of Processing – Request limited processing under certain conditions.

  5. Data Portability – Receive your Personal Data in a structured, machine-readable format.

  6. Objection – Object to processing based on legitimate interests or direct marketing.

  7. Withdrawal of Consent – Where processing is based on consent, withdraw at any time.

You may also lodge a complaint with your local supervisory authority or the UK Information Commissioner’s Office (ICO).


3. International Transfers

Livily is based in the United States. When transferring Personal Data from the EEA / UK / Switzerland to the U.S. or other jurisdictions lacking an adequacy decision, Livily uses one or more of the following safeguards:

  • Standard Contractual Clauses (SCCs) approved by the European Commission (Decision 2021/914);

  • UK Addendum to SCCs approved by the UK Information Commissioner;

  • U.S. Data Privacy Framework (DPF) participation where applicable.

4. Data Retention and Minimization

Livily retains Personal Data only for as long as necessary to fulfill contractual and legal obligations or legitimate business purposes, after which data are securely deleted or anonymized.
